AptaBook terms of service for business customers, including acceptable use, billing, and dispute resolution.

1. Agreement to Terms

By accessing or using the AptaBook platform and related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

AptaBook provides AI-powered scheduling, customer engagement, and related tools for service businesses. The Service may include chat and voice agents, calendar integration, knowledge base management, and other features as described on our website and in your plan.

3. Account and Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to use the Service to: violate any applicable law or regulation; infringe the intellectual property or other rights of any third party; transmit harmful, offensive, or illegal content; attempt to gain unauthorized access to the Service or related systems; interfere with or disrupt the integrity or performance of the Service; use AI agents to provide regulated professional advice (for example legal, medical, or investment advice) that your organization is not licensed to give, or to misrepresent that an AI response is a human professional; or send unsolicited bulk messages or spam through chat, voice, WhatsApp, email, or SMS channels. We may suspend or terminate your access if we reasonably believe you have violated these Terms or acceptable use.

5. SMS Text Messaging

AptaBook provides tools that allow businesses using the Service to send and receive SMS/MMS messages with their customers for customer care and transactional purposes only (for example, appointment scheduling, confirmations, reminders, and responses to customer inquiries). You will obtain appropriate consent before sending texts, send only messages related to your legitimate business relationship, honor opt-out requests including STOP replies, include required disclosures that message frequency varies and message and data rates may apply, and will not share end-user mobile numbers or messaging consent data with third parties for marketing. End users may consent by texting your business number, providing a mobile number when booking and agreeing to appointment-related texts, or other lawful consent methods. Recipients may reply HELP for assistance or STOP to unsubscribe. See our Privacy Policy for how we handle mobile information.

6. Payment and Billing

Paid plans are subject to the pricing and billing terms presented at signup or in your account. Fees are generally billed in advance. You are responsible for any taxes applicable to your use of the Service. Refund policies are as stated at the time of purchase.

7. Intellectual Property

We retain all right, title, and interest in and to the Service, including all software, content, and materials we provide. You retain ownership of the data and content you submit to the Service. You grant us a limited license to use that content to provide and improve the Service.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. Your use of the Service is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by law, we and our affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Changes

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Continued use of the Service after such changes constitutes acceptance of the revised Terms.

11. Service levels and support

We aim to keep the Service available for normal business use and monitor production continuously. Published marketing pages do not create a contractual SLA unless a separate written agreement says otherwise. Support is available at support@aptabook.com. Response times vary by plan and severity.

12. Data processing

You are responsible for the content and customer data you submit to the Service and for obtaining any consents required to process that data. Our Privacy Policy describes how we handle personal information. For healthcare use cases that require a Business Associate Agreement, contact us before enabling channels that may handle protected health information.

13. Governing law and disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules, unless a written order form specifies otherwise. Courts located in Collin County, Texas will have exclusive jurisdiction over disputes arising from these Terms, except where applicable consumer law requires otherwise.
